Refund & Cancellation Policy

This policy explains when you can cancel an order and when you will receive a refund. It forms part of our Terms of Service. IncorpLab is operated by IncorpLab LLC, a Wyoming limited liability company.

1. Cancelling Before We File

You can cancel any order before we submit it to the state, the IRS or the trademark office. You will receive a full refund, minus any third-party cost we have already paid on your behalf with your approval (for example, a Comprehensive Trademark Search that has already been commissioned). To cancel, email contact@incorplab.com with your order number.

2. After We File

Once a filing has been submitted, the government fee for it has been paid and our work has been done, so that filing is not refundable, except as set out in section 3.

3. Formation Refund Promise

If the state rejects your formation filing, we refund the full amount you paid for your formation order, including the state fee, the first year of registered agent service and any add-ons.

This does not apply if the rejection is caused by inaccurate or incomplete information or documents you provided. Processing delays are not rejections.

4. Services We Do Not Deliver

If we cannot deliver a service you paid for because of a reason on our side, we refund that service in full.

5. Identity Verification

If we cannot verify your identity under our KYC & AML Policy before filing, we cancel the order and refund it in full, unless the law prevents us from doing so.

6. Annual Services

Annual services (registered agent renewal, Annual Report or Delaware Annual Tax filing, and federal tax filing) are invoiced before the due date. They can be cancelled at any time before we file or renew for that year, and you will receive a full refund for that year. Once a renewal has been processed or a filing submitted, that year is not refundable. To stop future renewals, email contact@incorplab.com.

7. Trademark Orders

• Before filing: section 1 applies.
• After filing: the order is not refundable. A refusal by the trademark office is not a refund event; where the Refile Promise in our Terms applies, you receive a new filing with our professional fee waived instead.
• Government fees paid to a trademark office are never refundable once paid.
• If we cannot file at all because of a reason on our side, we refund in full.

8. What Is Not Refundable

• Government and trademark office fees once paid, except as stated in section 3.
• Delays by the IRS, state agencies or trademark offices.
• Problems caused by inaccurate or incomplete information you provided.

9. How Refunds Are Paid

Approved refunds are issued to the original payment method within 5 working days. The time for the money to appear in your account depends on your bank or card issuer.

10. Questions or Disputes
